Terms of Use

The app sells you a tool, not a service: once installed it runs on its own, on your device, and turns to the network only for the App Store and, if you turn it on, for your own iCloud sync. What follows is therefore mostly about the licence, the prices, and what is not being promised.

1. Scope

These terms govern use of Simple Thumbnail Maker, published by Sullivan Thimotée, and of this website. Installing the app means accepting them.

2. Licence

The app is distributed through Apple's App Store and, on that basis, grants you a personal, non-exclusive licence under Apple's standard end user licence agreement, which applies in full. These terms add to it without contradicting it; where they differ, Apple's agreement prevails.

3. Subscription and lifetime purchase

  • Subscription: €2.99 per year. It renews automatically unless cancelled at least 24 hours before the current period ends.
  • Lifetime: €9.99, a single payment, no renewal. It stays attached to the Apple ID used to buy it and can be restored from within the app.

Either one gives you unlimited exports and iCloud sync of your projects. Sync is optional and stays off until you turn it on. If the purchase lapses, syncing simply stops: nothing is deleted, and it is all still there if you come back.

Payment is charged by Apple to your account when the purchase is confirmed. Managing and cancelling happens in your Apple account settings, never in the app; we have no access to it. Refunds are Apple's to grant, under Apple's terms.

Prices may change for new purchases. A price change to an existing subscription would be notified to you by Apple, with the option to decline, as App Store rules require.

4. Free tier

Without a purchase the app can be used without limit to create, edit and preview. Only exporting is limited, to one every two weeks, however many variants it produces, and the same thumbnail may go out twice within the fortnight so you can test it and fix it. That limit may be adjusted in a future version; it will never make a project you already created inaccessible.

5. Your content

The photos you import and the thumbnails you produce are yours. We have no access to them, claim no rights over them, and could neither view nor retrieve them, wherever they are: on your device, or in your own iCloud account if you turned sync on.

Holding the rights to the images you use is your responsibility.

6. Reasonable use

You are asked not to decompile the app, not to redistribute it, and not to use it to produce unlawful or deceptive material.

7. Availability and warranties

The app is provided "as is". It is built carefully and tested, but no warranty is given that it is free of defects, or that any particular feature suits a particular purpose. Subject detection depends on the content of the photo and on the device: it may find nothing, in which case the corresponding feature disables itself.

8. Limitation of liability

To the extent the law allows, the publisher's liability is limited to the amount you actually paid for the app in the preceding twelve months. No liability is accepted for indirect loss, in particular lost revenue or lost audience.

9. Third-party trademarks

Simple Thumbnail Maker is an independent app. It is not affiliated with, endorsed by, or sponsored by YouTube or Google. YouTube is a trademark of Google LLC, referred to here only to describe the format the app prepares your images for.

10. Governing law

These terms are governed by Swiss law. Jurisdiction lies at the publisher's domicile, subject to any mandatory consumer protections in your country of residence.
